The first step in receiving SSI disability benefits is to file your initial social security claim with your local Social Security Administration office. Unfortunately, you will usually be denied SSI or social security benefits upon your initial application. If you are denied social security benefits, you then have only 60 days to file your first appeal, the Request for Reconsideration. If you are approved for SSI benefits, you will receive social security benefits dating back to the onset date of your injury. If this SSI appeal is denied, you then must file a Request for Hearing. This hearing will be before an Administrative Law Judge. The Administrative Law Judge will then render an opinion regarding your social security disability claim and award or deny you social security disability benefits. If you are denied social security disability benefits by the Administrative Law Judge, you may then appeal to the Social Security Appeals Council. The Appeals Council will either affirm the ruling of the Administrative Law Judge or remand the case back to the hearing stage. If the Administrative Law Judge's social security disability ruling is upheld, you may then appeal in United States District Court.
